TERMS AND CONDITIONS: CHANG SENSORY TRAILS

  • 1. Promotion

    “CHANG SENSORY TRAILS” (the “Promotion”) is a promotion organised and managed by Interbev (Singapore) Limited (“CHANG”).

    • (a) These terms and conditions shall apply to the Promotion and bind all Participants (as defined in clause 2(a)).
  • 2. Eligibility

    • (a) The Promotion is open to any individual who fulfil the following conditions (collectively the “Participants” and each a “Participant”):
      • (i) a Participant must be a Singapore Citizen, Permanent Resident or holder of a valid employment pass or work permit aged 18 years and above and residing in Singapore;
      • (ii) a Participant must not be an employee of CHANG, any of its affiliates, advertising agencies, other associated agencies, dealers, distributors, vendors or contractors, an employee of a Participating Outlet (see clause 4(b) below), an immediate family member of any such employee, or anyone else connected with the Promotion.
    • (b) CHANG reserves the sole and absolute right to assess and determine the eligibility of each Participant, and may require such information and documents as it considers necessary for the purposes of verifying the eligibility of an entry.
    • (c) CHANG also reserves the right to disqualify any Participant without assigning any reason whatsoever.
  • 3. Promotion Period

    The qualifying period of the Promotion is 15 July to 14 September 2022. The Promotion will end on 14 September 2022 at 23:59 hrs. Any submission after the promotion end date shall be disqualified and rejected automatically.

  • 4. Promotion Mechanics

    • (a) To enter a submission for the Promotion, a Participant must:
      • (i) Visit any of the brick-and mortar food and beverage outlets set out in Annex A (the “Participating Outlets”), and order and purchase the following items for consumption within the Participating Outlet’s premises:
        • (I) 1 x Participating Outlet’s signature dish chosen from the signature dishes listed on in-store displays for the Promotion; AND
        • (II) At least one 320ml bottle OR 320ml can of Chang Beer.
  • 5. Selection of Winners

    • (a) Out of all eligible Participants whose submissions qualify, four (4) winners shall be selected by CHANG in its sole and absolute discretion (the “Winners”) based on the following criteria:
    • (b) All decisions made by CHANG in relation to the selection of the Winners shall be final, conclusive and binding on all Participants and non-negotiable.
    • (c) The Winners will be contacted by CHANG via email or phone call registered in the Entry no later than 10 working days after the end date of the Promotion. Winners must, upon request, provide CHANG with all information necessary to facilitate the redemption of prize.
    • (d) The award of a Prize is subject to acceptance by the Winners. If the Winners cannot be contacted or does not respond to CHANG within 10 working days of CHANG's notification, or fails to provide the required verification(s), the Winners are deemed to have waived their right to the Prize. CHANG has the right to select supplementary Winners at its sole and absolute discretion. All decisions of CHANG in this regard are final and binding on all Participants.
  • 6. Prize and Conditions on the Prize

    • (a) Each Participant is eligible to win only one (1) prize.
    • (b) Each winner shall win:
      • (I) Two (2) Economy class return - air tickets from Singapore to Bangkok OR Phuket (to be determined at the sole discretion of CHANG),
      • (II) Hotel accommodation (1 room x 2 nights) at destination, AND
        • i. Two (2) vouchers worth SGD 100.00. to redeem at selected outlets in Bangkok OR Phuket (to be determined at the sole discretion of CHANG).
    • (c) The prizes are valid from 1 Oct 2022 – 30 April 2023; after which they will be considered expired and void.
    • (d) CHANG reserves its sole and absolute discretion to replace and substitute any part or all of the Prize with any other prize(s) of equivalent or similar values, at any time without prior notice without assigning any reason whatsoever. CHANG accepts no responsibility whatsoever for any variation and substitution of the Prizes and its values.
    • (e) The Prizes are not transferable and are not exchangeable for cash, credit, or other items in part or in full. CHANG shall not be responsible for any Prize in any event of loss, theft, damage etc after it has been delivered to a Winner.
    • (f) The Winner shall accept the Prize “as is” and the Company shall be under no obligation to entertain any request by the Winner to change any aspect of the Prize. CHANG makes no representation or warranty whatsoever as to the quality or fitness for purpose or any other implied terms and conditions with respect to the Prize awarded in the Promotion, and CHANG shall not be held liable for any loss, cost or damage to any person resulting or arising from any of the Prize or the use of it.
  • 7. Limitation of Liability

    • (a) Each of CHANG accepts no responsibility and shall not be liable for any loss, injury, expense, delay or irregularity arising out of or in connection with the Promotion.
    • (b) In particular and without limiting the generality of clause 7(a), each of CHANG makes no representation or warranty, expressed or implied and disclaims any and all liability, as to the condition, quality, merchantability or fitness for use of any goods and/or services pertaining and/or provided to, received and/or purchased by a Participant pursuant to the Promotion.
  • 8. General

    • (a) By participating in the Promotion, each Participant:
      • (i) agrees to and shall abide by these terms and conditions and all applicable laws and regulations of Singapore;
      • (ii) warrants and represents the truth and accuracy of all information and documents submitted to CHANG in relation to the Promotion;
      • (iii) warrants and represents that all elements contained in the submission:
        • (III) are and/or will be original to the Participant and fully cleared for use as contemplated for the Promotion to;
        • (IV) do and will not, in any way, violate or breach any of the terms of any other agreement the Participant may be a party to;
        • (V) are not unlawful, harmful, threatening, abusive, invasive of another’s privacy, harassing, defamatory, slanderous, tortious, vulgar, obscene, hateful, racist or otherwise offensive or objectionable to any other person or entity;
        • (VI) do not infringe or violate any copyright, trademark or other right (including the full spectrum of intellectual property rights), or contain any matter the publication or sale of which will violate any law, including federal or state statute or regulation; and
        • (VII) shall not require CHANG to pay or incur any sums to any person or entity as a result of CHANG's use or exploitation of the same;
      • (iv) unconditionally and irrevocably grants CHANG and its group of companies an exclusive right, and perpetual, worldwide, royalty-free, transferable license to post, display, publish, use, adapt, edit, and/or modify the videos / photos uploaded in accordance with clause 4(b) above to the public in all media including social media for promotional and marketing purposes in connection with the Promotion only without further reference, compensation or payment to the Participant; and
      • (v) agrees to provide their personal data and/or information to CHANG for verification, contact, products delivery and/or services in connection with the Promotion only. Each Participant understands and agrees that CHANG may collect, use and/or disclose such personal data and/or information provided for promotional and marketing activities via email, push notification and/or SMS, administration, feedback, surveys, market research, delivery of products by service providers or independent contractors, individualised services and/or disclose them to companies within CHANG’s group of companies in accordance with the Personal Data Protection Act 2012. The Participant further agrees to CHANG’s Privacy Policy set out at https://www.changbeer.com/privacy-policy/?lang=en;
      • (vi) acknowledges and agrees that each Participating Outlet’s goods and services is subject to availability, and a Participating Outlet may impose and require compliance with its own terms and conditions, house rules and/or policies (including those in relation to COVID-19 restrictions, and opening hours), for which CHANG shall not be responsible or liable; and
      • (vii) acknowledges and agrees that due to the ongoing COVID-19 pandemic, the conduct of the Promotion and fulfilment of the Prize may be suspended, postponed or terminated with no prior notice.
    • (b) Any of the Participant’s personal data and/or information collected for the purposes of the Promotion will not be retained by CHANG beyond the completion of the Promotion (the “Retention Period”). A Participant may withdraw consent to the collection, use and/or disclosure of their personal data and/or information at any time during the Retention Period by notice in writing to CHANG’s data protection officer(s) by clicking here. Any withdrawal of consent by a Participant to any collection, use or disclosure of such personal data and/or information will amount to an immediate withdrawal of the Participant’s submission for the Promotion.
    • (c) In accepting the Prize, each Winner:
      • (i) agrees to be featured in any CHANG collateral for publicity and announcement purposes in connection with the Promotion only;
      • (ii) acknowledges that CHANG may post news or updates about the Promotion and the Winner on its website and through other social media websites. However, CHANG is under no obligation to post content about the Winner and makes no representation and provides no guarantee as to when such content may be generated or published; and
      • (iii) acknowledges and understands that they are responsible for any tax payable in respect of the Prize.
    • (d) All personal costs and/or any other costs, fees and/or related expenses that are incurred or to be incurred to participate in the Promotion or after the Promotion are the sole responsibility of the Participants.
    • (e) The Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram, Facebook, Twitter or any other social media network.
    • (f) CHANG reserves its rights to amend, vary, modify, change, suspend, cancel, extend, remove or delete any terms and conditions of the Promotion at any time without prior notice and in any dispute arising out of this Promotion, the decision made by CHANG shall be final and binding onto the parties of the dispute. CHANG shall not be held liable to compensate and/or indemnify any Participant for any injury, loss or damages in any manner whatsoever in connection with the Promotion directly and/or indirectly.
    • (g) The laws of Singapore shall govern the terms and conditions of the Promotion. The Participants agree to submit to the non-exclusive jurisdiction of the courts of Singapore for all matters arising from or in relation to the Promotion.
    • (h) The Contracts (Rights of Third Parties) Act 2001 is hereby expressly excluded from application to these terms and conditions.
